HEMP 1

Hearing to consider the following: Agriculture Department presenting the Ordinance to amend Title 130 of the County Zoning Ordinance to enact regulations for the cultivation of industrial hemp pursuant to the Industrial Hemp Pilot Program Concept to the Planning Commission. The document will then be forwarded to the Board for consideration at the second reading and final adoption hearing at the Board of Supervisors on October 25, 2022.

Highlights of Proposed Ordinance Include:

  • Cultivation is proposed for parcels designated as Planned Agricultural (PA), Limited Agricultural (LA), Agricultural Grazing (AG), Residential Estate (RE), and Rural Lands (RL).
  • No setback proposed for Planned Agricultural (PA), Limited Agricultural (LA), and Agricultural Grazing (AG).
  • 200’ setback proposed for Residential Estate (RE), and Rural Lands (RL).
  • 200’ setback proposed from any parcel zoned as Multi-unit Residential (RM), Single-unit Residential (R), One-acre Residential (R1A), Two-acre Residential (R2A), Three-acre Residential (R3A), or Residential Estate (RE).

Odor Issues Explored at the 3/17/21 Board of Supervisors Ad Hoc Committee Meeting

  • The guest speaker, who is an expert air quality consulting engineer, stated that he did not find a difference in the intensity of odors between cannabis (marijuana) and hemp. This is primarily due to the fact that both marijuana and hemp are derived from the same plant.
  • Indoor operation confines odor, maybe 70-80% effective. Outdoor cultivation relies on dilution, space between cannabis canopy and where people live. Minimum buffer of 50-75’ plus mitigation, such as misting lines, odor neutralizer, effectiveness not as good as a greenhouse.
  • Outdoors at about 1000’ is sufficient to dilute odor plume enough for residence, although possible with winds that is not sufficient dilution and could create an odor bubble. Dilution relies on the atmosphere and Mother Nature may not cooperate.
