Virtual Special Board Meeting, Thursday, July 9, 2020 at 2:00pm

Chief Administrative Office recommending the Board of Supervisors receive an update on the status of COVID cases in El Dorado County and provide direction to staff regarding enforcement against businesses and individuals who fail to comply with state and local health requirements.

Through the state budget process El Dorado County was allocated approximately $19.7 million in CARES Act funding to offset the impact of COVID-19. In addition, on July 6, 2020, El Dorado County was informed we would receive approximately $2.8 million to backfill lost revenue for our realignment programs, including Social Services, Public Health, Behavioral Health and Public Safety. In order to receive these funds, the County Executive is required to submit two attestations by July 10th that we are adhering to all federal, state, and local health orders.

In a letter dated July 1, 2020, the Governor issued a letter to all California Elected Offices (https://eldorado.legistar.com/View.ashx?M=F&ID=8652954&GUID=0DADD04C-47C8-45E8-B1F3-48795A82D831) stating violations of orders issued under the Emergency Services Act are a misdemeanor and “calling on all elected officials to remain vigilant in the efforts to protect the health and safety of our communities, and more importantly, to ensure compliance with the state’s public health orders and utilize the authorities entrusted in you to protect your communities.” The letter also states, “A local government that refuses to abide by, ensure compliance with, or take enforcement action against noncompliance with these statewide public health directives, or that takes action that is otherwise incongruent with these directives, could jeopardize their eligibility for state funding.”

Item 22. 20-0866 HEARING - To consider separate requests by the Divide Preservation Society and Cool Pilot Hill Advisory Committee appealing the Planning Commission’s May 28, 2020 approval of Design Review DR19-0006/Cool General Retail to allow the construction of a 9,100 square foot commercial retail building and associated driveway, parking lot, utilities, signage, and landscaping improvements. The property, identified by Assessor’s Parcel Number 071-500-037, consisting of 1.69 acres, is located on the east side of California State Highway 49, south of the intersection with  Northside Drive, in the Cool Rural Center; and staff recommending the Board take the following actions:

1) Adopt the Mitigated Negative Declaration based on the Initial Study prepared by staff;
2) Adopt the Mitigation Monitoring Reporting Program in accordance with the California Environmental Quality Act Guidelines Section 15074(d), incorporated as Conditions of Approval; and
3) Deny the appeals, thereby upholding the Planning Commission's May 28, 2020, approval of Design Review DR19-0006/Cool General Retail based on the Findings (Attachment C) and subject to the Conditions of Approval (Attachment D). (Supervisorial District 4)
