City Council Actions:
Ceremonial Matters and Presentations
1. Presentation from Safer From Wildfires
Council received a presentation from Safer From Wildfires on achievable and effective wildfire recovery and readiness measures for homes and businesses.
Postponements and Orders of the Day
Council reordered the agenda to hear Item 23 before Item 22, and to hear Item 24 before any Consent Calendar items that are pulled for discussion.

Consent Calendar
Council approved Items 7-11, 13-16, 18, and 19 on the Consent Calendar as recommended in the Agenda. Council pulled Items 12 and 17 for discussion and moved both items after Item 24.
Second Reading of Ordinances
20. Second Reading of an Ordinance Amending Municipal Code Section 2.88.100: Audit Committee - Duties-Powers-Responsibilities
City Clerk Kirsten Squarcia read the title of Ordinance No. 22-2243: "An Ordinance of the City Council of the City of Cupertino Amending Municipal Code Section 2.88.100: Audit Committee - Duties-Powers-Responsibilities." Council took action to:
- read Ordinance No. 22-2243 by title only, and that the City Clerk's reading constitutes the second reading thereof; and
- enact Ordinance No. 22-2243.
Ordinances and Action Items
21. Approve the July 1, 2022 through June 30, 2025 Memorandum of Understanding for the Operating Engineers Local No. 3 Union, AFL-CIO) (OE3)
Council took action to:
- adopt Resolution 22-101 amending the Memorandum of Understanding (MOU) for the Operating Engineers Local No. 3 Union, AFL-CIO (OE3) based on the tentative agreements attached in the agenda packet;
- adopt Resolution 22-102 to approve budget modification 23-232, increasing budget appropriations by $471,742 ensuring that there are sufficient budget appropriations to cover the costs associated with the negotiated contract; and
- approve the corresponding Salary Schedule for OE3 employees effective July 1, 2022.
23. Approve the July 1, 2022 through June 30, 2025 Memorandum of Understanding for the Cupertino City Employees' Association (CEA)/IFPTE Local 21
Council took action to:
- adopt Resolution 22-107 amending the Memorandum of Understanding (MOU) for the Cupertino City Employees' Association (CEA)/IFPTE Local 21 based on the tentative agreements attached in the agenda packet;
- adopt Resolution 22-108 to approve budget modification 23-233, increasing budget appropriations by $721,354 ensuring that there are sufficient budget appropriations to cover the costs associated with the negotiated contract; and
- approve the corresponding Salary Schedule for CEA employees effective July 1, 2022.
22. Approve and Update Salary and Terms, Conditions of Employment, and New Job Classification for the Unrepresented (Management and Confidential)
Council took action to:
- adopt Resolution No. 22-103 amending the Compensation Program and salary schedules for the Unrepresented (Management and Confidential) Employees effective July 1, 2022;
- adopt Resolution No. 22-104; amending the Compensation Program for the Appointed Employees effective July 1, 2022;
- approve a new job classification of Sr. Public Works Project Manager;
- approve salary realignment for the classifications of Capital Improvement Project Manager to Transportation Manager and of Deputy City Manager to Assistant Director of Community Development/Building Official and Assistant Director of Parks and Recreation;
- accept title changes for classifications in the Unrepresented Employee Compensation Program;
- adopt Resolution 22-105 to approve budget modification 23-234, increasing budget appropriations by $1,152,236 ensuring that there are sufficient budget appropriations to cover the costs associated with the Unrepresented Employee Group; and
- adopt Resolution 22-106 to approve budget modification 23-235, increasing budget appropriations by $27,227 ensuring that there are sufficient budget appropriations to cover the costs associated with the Appointed Employee Group.
24. Priority Housing Sites for the 2023-2031 Housing Element Update
Following public comment on the item and Council discussion, Council continued this item to a Special City Council Meeting on August 29, with a potential continuation to August 30 if additional time is needed.
12. Climate Action Plan 2.0 (CAP 2.0) and GHG Emissions Thresholds
Following staff presentation and discussion, Council took action to:
- adopt Resolution No. 22-097 adopting the Climate Action Plan 2.0 and GHG Emissions Thresholds Initial Study/Negative Declaration
- adopt Resolution No. 22-098 adopting the Climate Action Plan 2.0 and GHG Emissions Thresholds
- modify CS 2.1: Study opportunities to create new natural areas in existing open spaces, parklands, and fields with native species, biodiverse ecology, higher carbon sequestration potential and improved recreational connectivity ecologically responsible recreation opportunities for the community.
17. Appointment of New 2023-2024 Cupertino Poet Laureate
Council adopted Resolution No. 22-100 approving the Library Commission's recommendation and appointment of Keiko O'Leary as the new 2023-2024 Cupertino Poet Laureate, with a referral to staff regarding selecting timing for bringing forth modifications to the Cupertino Poet Laureate playbook, for consideration by the Library Commission in the future.
Mayor's Corner with Darcy Paul
Dear Friends and Neighbors,
We hope that you have had a good summer thus far. With our schools starting again, fall is just around the corner. Our current Parks and Recreation guide is even, appropriately enough, notifying everyone of year-end holiday events. Our families and residents are adjusting to another season of activity and a number of positive prospects.
Our City Council has been actively helping to ensure that our changes are healthy, well-considered and cooperative. This past weekend, we ribbon-cut a new location for a farmers market after a number of conversations with De Anza Community College. Our City Council subcommittee comprised of Vice Mayor Liang Chao and Councilmember Jon Willey worked steadfastly to help ensure that we support the region’s local agricultural community comprised of smaller farms providing fresh produce directly to thousands each Sunday. Councilmember Kitty Moore led our efforts to organize and coordinate the ribbon-cutting event. On that early Sunday morning, we were proud to welcome this new location, an even more expansive space which will undoubtedly be able to serve more residents in the future.

We also have the future in mind with a couple of other upcoming Council-led events. This Saturday afternoon, August 27th, at 4:00 p.m. at the future site of a significant park informally designated Lawrence-Mitty (for now), we are going to be holding an Annexation Ceremony. We purchased the land from the County about two years ago, and so we’ve asked County Supervisor Joe Simitian to speak, as he and his office were integral to these efforts to purchase the parcels. We then annexed the land from San Jose, and so we’ve asked Vice Mayor Chappie Jones to speak, as our work together was important in ensuring that annexation went smoothly. It will be a great space with many positive future usages, from traditional park-related activities to the fact that it extends further north the Saratoga Creek Trail.
Also this upcoming weekend, we are through my office in conjunction with a couple of area historical organizations, hosting an Augmented Reality Workshop. We have made outreach to all socioeconomic sectors of our community, as this technology we anticipate will be used by everyone to help tell their stories. As such, we believe that we can do our part to make this readily available by inviting more people in to learn about this exciting and interesting way of delivering content at the outset of its usage. The workshop has been met with high interest, and we are grateful to our partners at De Anza College for providing the space, to our local Cupertino Historical Society for helping us coordinate and outreach locally, and to the Chinese Historical Society of America Museum in San Francisco for their work not just in bringing forth this cutting-edge use of AR, but working with us to bring it to a broad and inclusive audience.
This time of the year is also when India Independence Day is observed. With a significant proportion of our population from India, we are pleased to be able to support this observation and celebration of the world’s largest democracy. This is the 75th anniversary of that celebration, and the 76th celebration of that democratic system. Similarly, we have celebrated 6 times and this is the 5th anniversary of our observance in Cupertino, organized by our committee for our sister city with Bhubaneswar, India.

Cupertino seems to be defined by our diversity and the incredibly wide variety of perspectives that we have in our community. I believe that that’s why we are able to nurture basic services and products that have such a far-ranging impact. This is not just particular consumer products. This is also about systemic practices and the way we set forth our community discussions. Thank you for standing with us to help keep these practices going, and we will keep working with the community to bring forth positive and healthy reflections and changes.
