Rental Registry/Anti-Harassment Ordinance
At its May 13 meeting, the City Council will reconsider a citywide Rental Registry and Tenant/Landlord Anti-Harassment Ordinance. This meeting will be held in the City Council Chamber and streamed on Zoom.
At its meeting on February 11, 2025, there were not three or more votes on the City Council supporting the establishment of a Claremont Rental Registry. At that time, Councilmember Reece had recused himself because he owns residential rental property in Claremont, which may present a disqualifying financial conflict of interest. The other four members of the City Council directed staff to bring the rental registry discussion back to the City Council if the Fair Political Practices Commission (FPPC) determined that Councilmember Reece does not have a conflict of interest and can participate. On February 11, the City Council (with Councilmember Reece recused) also introduced and approved a first reading of an Anti-Harassment Ordinance and directed staff to conduct stakeholder outreach before the second reading of this “Anti-Harassment” Ordinance.
Councilmember Reece received guidance from the FPPC on May 1, 2025. The FPPC letter advises Councilmember Reece that he has a disqualifying conflict for both the Rental Registry and the Anti-Harassment Ordinance, unless the proposal is applicable to all residential rental units in the City of Claremont. If the proposal is applicable to all residential rental units, then an exception applies that is commonly referred to as the “public generally” exception. If the proposal would carve out certain rental units (e.g., rental units owned by “mom and pop” landlords), then the “public generally” exception does not apply, and Councilmember Reece would need to recuse himself.
In light of this guidance, staff has prepared an item for the May 13, 2025 City Council meeting to seek policy direction on versions of a Claremont Rental Registry and an Anti-Harassment Ordinance that would be applicable to all rental units in the City of Claremont. More information can be found in the City Council agenda packet.
