This notice is being sent to all firms that are registered to do business with the City of Tucson’s Procurement Division. The City appreciates your interest in providing goods and services to the City of Tucson, as well as your presence in the business community. Accordingly, the City is sending this notice to keep you informed of recent changes in legislation.
At the November 2021 General Election, Tucson voters approved Proposition 206, "The Tucson Minimum Wage Act." The Act established a local minimum hourly wage of $13.00, beginning on April 1, 2022, which will increase incrementally every year to $15.00 an hour by January 1, 2025. Information about the Act can be found here: www.tucsonaz.gov/minimumwage
The Tucson Minimum Wage Act applies to all employers in the City, but there are additional wage requirements that might apply to your firm if you hold any contract with the City of Tucson for the provision of services to the City, which might require payment of wages higher than the Tucson Minimum Wage. The Tucson Living Wage applies to employees who perform work under certain types of non-construction service contracts with the City. Information about the City’s Living Wage requirement can be found at this website: https://tucsonprocurement.com/bidders_livingwage.aspx
If your firm holds any contracts with the City of Tucson for federally funded construction on publicly owned property, be advised that you will be required to pay the prevailing wages that are set under the federal Davis-Bacon & Related Acts, if those wages exceed the Tucson Minimum Wage. Information about current prevailing wage determinations are available on the SAM.gov website: https://sam.gov/wage-determination/AZ20220018/1
The City recently established a Labor Standards Unit to monitor and ensure compliance with applicable labor standards such as employee wages. Information about the City of Tucson’s Labor Standards Unit can be found here: www.tucsonaz.gov/minimumwage
