Background
Following our recent bulletin announcing changes to MCESD's permitting requirements for wastewater treatment facilities (EROP Case ES-2025-005), the Department has received inquiries from stakeholders regarding whether this change affects septic system permitting. This bulletin is intended to clarify that it does not.

Septic Systems Are Not Affected
The Board of Supervisors action approved on June 24, 2026 applied specifically to wastewater treatment facilities — centralized treatment plants that treat and discharge effluent. It has no effect on the permitting requirements for onsite wastewater treatment systems (septic systems).
Unlike wastewater treatment facility oversight, septic system permitting is delegated to MCESD by ADEQ. The Department will continue to review and permit septic systems as it has previously. There are no changes to submittal requirements, review processes, or inspection procedures for septic systems.
