Statement on Board Action Regarding Recorder's Lawsuit
“Today we authorized outside legal counsel to respond to Recorder Justin Heap’s lawsuit against the Board of Supervisors by filing a motion to dismiss the lawsuit and by filing a counter claim seeking declaratory relief from the court.
Board members have negotiated in good faith with the Recorder for the past several months on a shared services agreement that would outline responsibilities regarding elections administration. Unfortunately, an agreement could not be reached.
It is imperative to find a resolution before the 2026 election cycle. Certainty and consistency in administering elections is what our hard-working, dedicated employees and our voters deserve.”
