Maricopa County Recorder Stephen Richer Takes Action to Protect Voter Information

September 16, 2021 (Phoenix) – The Maricopa County Recorder’s Office today made a referral of potentially illegal activity to the Election Integrity Unit in the office of Arizona Attorney General Mark Brnovich.

The referral arose out of reports of voter files having been posted on the internet as well as being sent to unauthorized individuals. Maricopa County Recorder Stephen Richer called the issue troubling and hoped to see quick action from the Attorney General’s Office. 

“I take any allegation of wrongdoing very seriously, especially when it comes to the potentially illegal use of information that my office administers,” said Recorder Stephen Richer. “Every public records request this office responds to requires the individual or organization receiving the information to certify that the information will not be posted on the internet. We do this to safeguard protected information of Maricopa County constituents. It appears that in this case, information from a public records request may have been posted in violation of state law. I trust the Attorney General will look into this and take any necessary action.”

A.R.S. § 16-168(F) states that “[a] person in possession of information derived from voter registration forms or precinct registers shall not distribute, post or otherwise provide access to any portion of that information through the internet except as authorized by subsection I of this section … A person who violates this subsection or subsection E of this section is guilty of a class 6 felony.”

El Registrador del Condado Maricopa, Stephen Richer, Toma Medidas para Proteger la Información de los Votantes

16 de septiembre del 2021 (Phoenix) – La Oficina de Registro del Condado Maricopa hizo hoy una remisión de actividad potencialmente ilegal a la Unidad de Integridad Electoral en la oficina del Procurador General de Arizona, Mark Brnovich. 

La remisión surgió a raíz de informes de que los archivos de los votantes se habían publicado en Internet y se habían enviado a personas no autorizadas. El Registrador del Condado Maricopa, Stephen Richer, llamó al tema preocupante y que esperaba ver una acción rápida de la Oficina del Fiscal General.

"Me tomo muy en serio cualquier acusación de irregularidades, especialmente cuando se trata del uso potencialmente ilegal de la información que administra mi oficina," dijo el Registrador Stephen Richer. "Cada solicitud de registros públicos a la que responde esta oficina requiere que la persona u organización que recibe la información certifique que la información no se publicará en Internet. Hacemos esto para salvaguardar la información protegida de los electores del Condado Maricopa. Parece que, en este caso, la información de una solicitud de registros públicos puede haber sido publicada en violación de la ley estatal. Confío en que el Fiscal General investigará esto y tomará las medidas necesarias."

A.R. S. § 16-168(F) establece que “[una] persona que posea información derivada de formularios de registro de votantes o registros de recintos, no distribuirá, publicará ni proporcionará acceso a ninguna parte de esa información a través de internet, excepto según lo autorizado por la subsección I de esta sección…Una persona que viole esta subsección o la subsección E de esta sección es culpable de un delito grave de clase 6.”
