Dear Licensee,
This is a reminder regarding the fire inspection requirements outlined in A.A.C. R9-33-202.B.1.
As previously communicated in March 2025 to the Division of Developmental Disabilities and to providers on April 1, 2025, the Arizona Department of Health Services (ADHS) no longer conducts fire inspections for the purpose of licensure or renewal.
The Department always defers to the local jurisdiction first for completion of fire inspections. To remain in compliance with the rule, please ensure the following:
- Local Jurisdiction: Inspections must be conducted by your local fire jurisdiction whenever available.
- Refusal Documentation: If the local jurisdiction cannot perform the inspection, you must obtain written documentation from them confirming the refusal.

Third-Party Vendors: Only after receiving written confirmation of refusal from the local jurisdiction may you utilize a licensed third-party vendor.

Exemptions: If the local jurisdiction determines the home is exempt, you must provide written documentation from the jurisdiction confirming the exemption.
Additionally, when submitting an initial application or renewal, providers should ensure the required fire inspection (or applicable documentation) is completed prior to submission to help avoid delays and support timely processing of the application.
Providers are responsible for coordinating directly with their local fire jurisdiction and, if applicable, securing appropriate documentation before utilizing a third-party vendor.
