Sponsoring organizations and institutions are required by regulation to keep Bulletins, Instructions, and USDA Policy Memorandums for reference and to apply immediately the appropriate instruction to agency programs. Civil Rights in Child Nutrition Programs and the Bostock Rescission
On July 7, 2025, James C. Miller, Administrator of the U.S. Department of Agriculture (USDA) Food and Nutrition Service, issued a memo rescinding previous guidance based on the 2020 Bostock v. Clayton County Supreme Court decision.
This notice applies to all child nutrition programs including the National School Lunch Program, School Breakfast Program, Child and Adult Care Food Program, Summer Food Service Program, and Fresh Fruits and Vegetable Program, as well as Farm to School/Farm to Child Nutrition Grants that are awarded by the Alaska Department of Education and Early Development (DEED).

Please note that this is not policy guidance. This notice has the force law because it is based on an executive order.

Indirect Cost Rate
Sponsors can submit their Negotiated Indirect Cost Rate Agreement (NICRA) or Certification of De Minimis Indirect Cost Rate annually. This submission ensures that Child Nutrition Programs approve grants and programs for your agency with the appropriate indirect cost rate.
You can submit your NICRA or de minimis rate through the CNP Form Submission Studio.

 Civil Rights for Child Nutrition Training
The Alaska Department of Education and Early Development (DEED) is pleased to announce the next two Civil Rights Training sessions.
Training on the 27th of August will be recorded and available for download. Participants will be able to complete the training offline and request a certificate. More details will be distributed shortly after the training (likely after Labor Day).
This training will cover Civil Rights in the Child Nutrition Programs. Major topics covered include:
- Program Access and Civil Rights Assurances
- Meal Accommodations
This training is intended for all Child Nutrition Programs including
- The School Nutrition Program
- National School Lunch Program (including NSLP Snack)
- School Breakfast Program
- Fresh Fruit and Vegetable Program
- The Child and Adult Care Food Program
- Summer Nutrition Programs
- Summer Food Service Program
- Summer Seamless Option
All program sponsors must participate in one of Civil Rights in Child Nutrition Programs 2025 training.
 FY26 Cash-in-Lieu (CIL) Rate
In addition to cash reimbursement, USDA makes donated agricultural foods or cash-in-lieu of donated foods available to institutions participating in CACFP.
The USDA has released the Cash in Lieu of donated foods (CIL) rate for 2025-2026. Effective from July 1, 2025 through June 30, 2026, the CIL value is 30.50 cents per meal or $0.3050. This has been formally published on the Federal Register.

Resources
Updated WIC Food Guide
The Women, Infants, and Children (WIC) Program has updated their food lists. These food lists can be used by CACFP operators to help identify breakfast cereals that can qualify as whole grain rich.
Please note that program operators should still check whether these meet the new added sugar limits.

USDA Nondiscrimination Statement (English)

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Office of the Assistant Secretary for Civil Rights (OASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
