Dear New Yorker:
Since the beginning of the COVID-19 crisis, the New York State Department of Labor has been working day and night to connect New Yorkers with their benefits as efficiently as possible.
In reviewing our records to ensure New Yorkers are receiving the benefits they are eligible for, we identified an overpayment on your account. This duplicate payment was mistakenly made as part of an effort to deliver benefits to New Yorkers as quickly as possible, but, under federal law, NYS DOL is required to recover any overpaid funds.
You have the right to appeal this determination. You will receive a “Notice of Determination of Overpayment” in the mail from the Department of Labor in the coming days with information about this overpayment, the amount owed, how the money will be recovered, and the appeal process, as well the process for requesting a waiver if you continue to experience financial hardship. Please keep an eye out for that letter and follow the instructions.
If you want to submit a waiver, you will receive a DocuSign form via email. If you do not receive the DocuSign form, you can request a waiver application online starting Friday, April 23 at 12 pm.
Unless you file a timely request for a hearing or waiver, NYS DOL will begin recovering payments from your benefits after 30 days. All unemployment benefits will be reduced by 20% until the overpaid funds are recovered.
