Line Speed Waiver Extensions Clarification

On March 17, 2025, Secretary of Agriculture Brooke Rollins directed FSIS to extend waivers previously granted to certain young chicken and swine slaughter establishments. The extension allows these establishments to maintain faster line speeds while FSIS conducts rulemaking to propose to codify the faster maximum line speeds. FSIS is clarifying that the extension is limited to young chicken and swine establishments currently operating under line speed waivers. Thus, FSIS will not issue new line speed waivers. FSIS previously made clear it was not accepting new poultry or swine line speed waiver requests.

On March 20, 2020, FSIS stopped accepting additional poultry line speed waiver requests because the agency determined that, based on the waivers it had approved and the additional waiver applications under review at that time, enough establishments would be operating under line speed waivers for FSIS to assess the effectiveness of the 2018 line speed waiver eligibility criteria and to determine whether to move forward with rulemaking.

All establishments currently operating under swine line speed waivers were among the establishments that FSIS approved to participate in swine Time-Limited-Trials (TLTs) established in November 2021. While all NSIS swine establishments were invited to apply (and only NSIS swine establishments were invited to apply), FSIS approved six establishments to run the TLTs.
