Issue: New Bankruptcy Provision 11 USC 1328(i)
On December 27, 2020, the Consolidated Appropriations Act created a new (temporary) subsection (i) of section 1328 of the Bankruptcy Code. This new subsection permits a court to grant a chapter 13 debtor a regular discharge after considering factors outlined in section 1328(i). This new subsection will sunset on December 27, 2021.
A debtor must request a discharge under 1328(i) by filing a motion and proposed order using a specific event:
[Bankruptcy > Motions/Applications> Motion for Discharge Pursuant to Section 1328(i)]
The court will set a hearing on this type of motion.
