CSMS # 66002597 - Customs Bonded Facility Violations
Recent unannounced operations at Customs Bonded Facilities (CBF) have yielded numerous cases of violations. This notice is intended to remind CBF operators of authorities that U.S. Customs and Border Protection (CBP) Port Directors may exercise in cases of violations. These authorities can include revocations or suspensions.
- Approval of application through fraud 19 CFR 19.3(e)(1)
- Neglecting or refusing a proper order of a CBP Officer 19 CFR 19.3(e)(2)
- Criminal convictions of proprietor or Officer of the corporation 19 CFR 19.3(e)(3)
- Not providing secure facilities or safeguarding merchandise 19 CFR 19.3(e)(4)
- Not providing employee lists or complete employee lists 19 CFR 19.3(e)(5), 19.3(d)
If a CBF is utilizing a temporary agency for staffing, it is a best practice to require the staffing agency to utilize E-Verify. Multiple operations in CBFs have yielded criminal illegal aliens who were employed through staffing agencies and were working and encountered during CBP CBF operations.
