Reminder: USMCA Vehicle Certification Submission Requirements for Labor Value Content (LVC), Steel Purchasing, Aluminum Purchasing, Alternative Staging Regime (ASR) Certifications and Entry Filing for Vehicle Certification Unique Identifier - effective May 19, 2025.
This notice is to remind the trade community that pursuant to the Interim Final Rule (IFR) published on January 17, 2025, in the Federal Register 90 FRN 6456, U.S. Customs and Border Protection (CBP) added implementing regulations for the preferential tariff treatment and related customs provisions of the Agreement between the United States of America, the United Mexican States, and Canada (USMCA) including implementing regulations for automotive goods.
Accordingly, CBP added implementing regulations to 19 CFR 182, Subpart I on USMCA covered vehicles (i.e., passenger vehicles, light trucks, and heavy trucks) certification requirements and the procedures for vehicle producers to submit to CBP their USMCA steel purchasing, aluminum purchasing, labor value content (LVC), and alternative staging regime (ASR) certification requests for review/approval. The IFR also outlined the requirement for submission of the CBP-issued USMCA vehicle certification unique identifier for the applicable USMCA vehicle certification to CBP at entry summary or at post importation. Additionally, the IFR provided delayed compliance for these requirements effective May 19, 2025.
Vehicle Producer Submission to CBP of USMCA Auto Certification Requests
Effective May 19, 2025, producers of USMCA covered vehicles must submit to CBP through an authorized electronic data interchange system or other specified means, at least 90 days prior to the beginning of the vehicle certification period, the LVC certifications (pursuant to 19 CFR 182.95), steel purchasing certification (pursuant to 19 CFR 182.96), aluminum purchasing certification (pursuant to 19 CFR 182.97) to include the additional required data elements pursuant to 19 CFR 182.95(c), 182.96(c), or 182.97(c) and the Department of Labor (DOL) regulations at 29 CFR part 810. Additionally, producers of USMCA covered vehicles subject to an active exemption under an ASR authorized by the United States Trade Representative (USTR) must comply with the requirements pursuant to 19 CFR 182.95 (b) 182.96 (b), or 182.97 (b) and 182.106 (c).
Importer Submission of the CBP-issued USMCA Vehicle Certification Unique Identifier
CBP assigns a USMCA vehicle certification unique identifier for each USMCA vehicle certification request submitted to CBP for review and approval, including the steel purchasing certification, aluminum purchasing certification and the ASR certification, as well as the LVC certification request that is jointly reviewed and approved by DOL and CBP.
Effective May 19, 2025, and pursuant to 19 CFR 182.92, an importer (or the authorized agent of the importer) making a claim for USMCA preferential tariff treatment for the covered USMCA vehicle must include – on the entry summary or equivalent document, or by the method specified for equivalent reporting via an authorized data interchange system – the USMCA vehicle certification unique identifier assigned by CBP for each of the approved USMCA vehicle certifications: steel, aluminum, LVC, and ASR, pursuant to 19 CFR 182.11. The importer also has the option of providing this information at post-importation within one year after the date of importation pursuant to 19 CFR 182.31 and 182.32.
USMCA vehicle certification requests submitted to CBP prior to May 19, 2025, are not required to comply with these USMCA vehicle certification submission and entry requirements.
