CSMS # 65015372 - Facility Requirements for Bonded Warehouse Entries (19 CFR Part 144, Subpart B)
Merchandise that is the subject of a warehouse entry shall be sent to a bonded warehouse except for merchandise for which an immediate withdrawal is filed or merchandise which is designated for examination elsewhere than at the warehouse. See 19 CFR 144.14.
Bonded warehouses, as defined in 19 CFR 19.1, do not include container freight stations, inspectional facilities, express consignment facilities, etc., and therefore are not authorized for acceptance of Type 21/22 bonded warehouse entries.
Please be advised that bonded warehouse entries (Entry Type 21/22) require designation of the mandatory data element of the facility’s associated Facilities Information and Resource Management System (FIRMS) code, as required by 19 CFR § 144.11(c). Type 21/22 entries submitted without a FIRMS code or with an inaccurate FIRMS code will not be authorized for deposit in any warehouse until the entry is corrected. CBP is not responsible for charges incurred as a result of the delay in correcting the entry information.
As a reminder, ACE Report TA-003 (Public FIRMS) provides a list of CBP facilities with information including FIRMS codes and facility types. TA-003 can be used to determine if a location is classified as a bonded warehouse prior to submitting a Type 21/22 entry.
In addition to any delays in deposit of merchandise in the warehouse, filing a Type 21/22 entry with inaccurate bonded warehouse information may result in assessment of penalties or liquidated damages depending on the facts and circumstances.
