CSMS # 61785594 - Updated Export License Procedures for Shipments of White Grape Juice Concentrate from Argentina
The purpose of this message is to inform Customs Brokers and importers about the new requirements to submit Argentine White Grape Juice Concentrate (WGJC) export licenses to CBP and report the export license number when filing the /entry summary.
On March 24, 2023, the U.S. Department of Commerce (DOC) published in the Federal Register (88 FR 17801) the agreement suspending the Countervailing Duty investigation on WGJC from Argentina; and on May 19, 2023, the DOC provided instructions to U.S. Customs and Border Protection (CBP) in message #3139409. In accordance with the Suspension Agreement and the DOC instructions, effective May 16, 2023, CBP shall require presentation of an export license as a condition for entry of all consumption entries of WGJC from Argentina into the United States. See message #3139409 for the scope of the merchandise covered by the Suspension Agreement. This export license requirement does not apply to shipments of WGJC from Argentina that were exported before May 16, 2023.
Importers are required to submit the export license as a condition of entry for imports of WGJC from Argentina. Any entry released without the export license having been successfully submitted to CBP into the Document Image System (DIS) are subject to redelivery. Failure to redeliver shipments of WGJC from Argentina at the request of CBP may result in the imposition of liquidated damages and will be reported to Commerce as entries potentially in violation of the Suspension Agreement.
The instructions for submitting the WGJC export license in DIS and the license number with the entry summary are as follows:
- Transmit the Argentine WGJC export license into DIS. - The Argentine WGJC information will be entered on the entry summary (AE) record identifier 52 (input). Code 31 should be used in the License/Certificate/Permit type code field. Transmit the Argentine White Grape Juice export license number in the License Number/Certificate Number/Permit Number field without any dashes (i.e., 1-23-45-678910 = 12345678910). Follow the ACE ABI CBP and Trade Automated Interface Requirements (CATAIR) formatting instructions for submitting a 52-record data element.
