Per Federal Register Notice 85 FR 83804 Published 12/23/2020, e214 filers will be required to include one or more Aluminum Import License Numbers in the FT60 record(s) using a qualifier code of ALU when importing qualifying Aluminum HTS codes (see attachment). This requirement was delayed from 1/25/21 to 3/29/21. This is a reminder that the e-214 transaction has been updated to accept the aluminum import license data. Please include the required data for qualifying FT transactions starting 03/29/2021. An updated version of the CATAIR FTZ chapter and Appendix P are available on CBP.gov. *** ALUMINUM IMPORT MONITORING AND ANALYSIS SYSTEM (AIM): REGULATORY FREEZE AND DELAYED EFFECTIVE DATE ***
Pursuant to the White House Chief of Staff’s memorandum concerning “Regulatory Freeze Pending Review” issued on January 20, 2021, the U.S. Department of Commerce (Commerce) is delaying the effective date of the final rule, entitled “Aluminum Import Monitoring and Analysis System,” from January 25, 2021 to March 29, 2021. The final rule was published on December 23, 2020 and can be found here: https://www.federalregister.gov/d/2020-28166. Commerce has submitted a notice to the Federal Register delaying the effective date of the final rule in order to allow the incoming Administration time to review the final rule and consider any additional comments before implementation.
This delay means that licenses will no longer be required for covered aluminum product imports beginning on January 25, 2021, as was previously stated in the final rule. Unless otherwise announced, the final rule will go into effect, and licenses will be required, beginning on March 29, 2021. The AIM system website (https://www.trade.gov/aluminum) continues to be operational and will provide further guidance on licenses already issued and the issuance of new licenses during the intervening period prior to March 29, 2021. Further information on the AIM monitor will also be provided on the website.
Please note that in the case of any discrepancies between this announcement and the Federal Register notice delaying the effective date of the final rule, that the Federal Register notice prevails.
