CSMS #41257565 - Update: Section 321 Seller/Shipper Clarification
On September 28, 2019, U.S. Customs and Border Protection (CBP) deployed Entry Type 86 for entry of Section 321 low-valued shipments through Automated Commercial Environment (ACE). This new entry type will improve import safety and security by providing greater visibility into low value shipments. Please note that this new entry type is a test and is not mandatory for users.
Federal Register Notice (FRN):
A Test Notice was published in the Federal Register (FR) on August 13, 2019, which referenced that an entry type “86” requires the owner, purchaser, or customs broker appointed by the owner, purchaser, or consignee to file the following data elements with CBP at any time prior to, or upon arrival, or up to 15 days after arrival of the cargo: (1) The bill of lading or the air waybill number; (2) Entry number; (3) Planned port of entry; (4) Shipper name, address, and country; (5) Consignee name and address; (6) Country of origin; (7) Quantity; (8) Fair retail value in the country of shipment; (9) 10-digit HTSUS number; (10) IOR number of the owner, purchaser, or broker when designated by a consignee (conditional).
CBP and Trade Automated Interface Requirements (CATAIR) ACE Cargo Release:
Version 23 of the CATAIR for Cargo Release references that for type 86, the following data elements are required: Consignee and Seller’s information are required: (1) The bill of lading or the air waybill number; (2) Entry number; (3) Planned port of entry; (4) Seller name, address, and country; (5) Consignee name and address; (6) Country of origin; (7) Quantity; (8) Fair retail value in the country of shipment; (9) 10-digit HTSUS number; (10) IOR number of the owner, purchaser, or broker when designated by a consignee (conditional).
Because of differences in parties listed between FRN and CATAIR, for the purpose of this test, shipper information should be entered into the seller party area for type 86 entry filings.
