Chair Sieben elected NARUC Second Vice President
Chair Katie Sieben was recently elected as the Second Vice President of the National Association of Regulatory Utility Commissioners (NARUC). In this role, Chair Sieben will support NARUC's central mission to improve the quality and effectiveness of public utility regulation, empowering state regulators to collaborate on national challenges like advancing reliable and resilient infrastructure.

The Commission approved the repowering of the Elm Creek Wind project with modifications that will help the turbines be more efficient and generate more power overall. The permit term was also extended from 2030 to 2056. (Docket 09-553)

The Commission accepted CenterPoint’s first annual report on its Natural Gas Innovation Act plan activities. CenterPoint shared early details about its Networked Geothermal pilot, its plan to purchase renewable natural gas generated from organic waste, efforts to weatherize inefficient homes, and more. The Commission approved Basin Electric’s extension to file their IRP by October 1, 2027. They required Basin Electric to file an Interim Optional Integrated Resource Plan and current Basin Electric forecasted Minnesota retail load on July 1, 2026. (Docket 25-266)

The Commission approved the utilities’ Energy Conservation and Optimization (ECO) requests for incentives and recoveries. These are annual filings in which utilities request financial incentives, tracker approvals, and true-up riders for conservation activities. (Dockets 25-43-50)

The Commission approved Xcel Energy’s consolidated 2024 annual true-up filing, which authorized a $27.1 million refund to electric customers and a $1.6 million gas deferral plan for gas customers. (Docket 25-277)

The Commission approved Xcel Energy’s annual Transmission Cost Recovery Rider, which covers transmission costs in between rate cases. The filing included grid modernization projects and three new transmission projects: Brooking Second Circuit (MN/SD), Bayfront to Ironwood (WI/MI), and MISO LRTP2 Alexandria to Big Oaks (MN). The Commission denied a request for reconsideration of its September 16, 2025, Order in the Carbon-Free Standard (CFS) docket. (Docket 23-151)

The Commission approved the transfer of Lumen’s Minnesota mass markets fiber business to AT&T. The settlement agreement between Lumen, AT&T, the Legal Services Advocacy Project, the Minnesota Department of Commerce and the Office of the Minnesota Attorney General broadly addresses the following areas: (1) having enough technicians and budget to operate the network; (2) taking measures to address concerns about plain old telephone service (POTS) facility repair, rehabilitation and replacement; (3) customer service concerns; (4) alternative transition plans for discontinuance of service in an area, and (5) continuation of low-income customer programs. The Commission approved a route permit for the approximately 8.5-mile 161 kV transmission line project in Jackson County to ITC Midwest. (Docket 24-232)

The Commission approved Dakota Electric Association’s modifications to the Cooperative’s extension of service tariff for extraordinarily large commercial and industrial customers and system-intensive customers, which included the Cooperative’s letter of authorization and engineering and construction agreements. (Docket 25-178)

The Commission approved Otter Tail Power’s investment in the Hoot Lake Battery project and recovery of the costs of the project through the Renewable Resource Cost Recovery Rider (RRCR). (Docket 25-395)

Bent Tree North Wind Farm: On November 17-18 the PUC held a public hearing and took public comment on Wisconsin Power & Light Company’s application for a site permit for the Bent Tree North Wind Farm, a new up to 153 MW Large Wind Energy Conversion System in Freeborn, Hartland, and Bath townships in Freeborn County; Byron and New Richland townships in Waseca County; and Berlin Township in Steele County.

Lemon Hill Solar Project: On November 19-20 held a public information and environmental assessment scoping meeting for the Lemon Hill Solar project site permit application to construct and operate a 180 MW solar energy generating facility in Olmsted County. Public comment is open through December 8.

Otter Tail Power Rate Case: OTP requested rejection of Dept, OAG, and CUB arguments to modify the interim rates proposed and proposes to increase the credits available under its Uplift program for Jan – Apr 2026 and noting OTP will refund approx. $3 million of excess from the Energy Adjustment Rider concurrent with interim rates go into effect Jan. 1, 2026 which provides bill savings to all customers. OTP also argues for including Coyote Station’s undepreciated plant balance in interim rates. OAG reply agrees with Dept and CUB on exigent circumstances and believes the PUC could make the case for either Dept or CUB’s proposal but should first require OTP to make the $3.2 million adjustment for Coyote Station.

Xcel Gas Rate Case: The OAG proposed capping interim rates at the amount requested in the stay-out proposal and referred the case to the CAH for record development, specifically including executive compensation review. The Department recommended accepting the application as complete and referring it to CAH. The Dept. advised limiting the proposed interim rate revenue deficiency for residential customers to $16.2 million or 50% of the request. Additionally, the Dept. recommended approval of the base cost of gas, pending review of demand entitlement and cost information requested in the reply. The Citizens Utility Board made recommendations:
- Suspend final rates and refer the case to CAH for a contested case
- Reduce the interim rate increase due to exigent circumstances related to the federal government shutdown.
- Approve CUB's petition to intervene.
- Require Xcel to notify customers by email of the proposed rate increase, including a live link to instructions on filing public comments.

Xcel Energy, Minnesota Power, and Otter Tail Power Co. filed IEEE benchmarking data in the annual Service Quality, Safety, and Reliability reports which compares utility service reliability to similar utilities in the nation. Xcel Energy met two of the reliability thresholds (SAIDI and CAIDI) for 2024 and missed the third (SAIFI) by 0.07 interruptions. Minnesota Power met these major event-excluded target goals for SAIDI by 30.1 minutes and CAIDI by 35.59 minutes but failed to meet its goals for SAIFI by 0.15. Otter Tail Power met the reliability goal (SAIDI) compared to similar-sized utilities for Minnesota total customers but did not when compared to all utilities with the most significant events being summer storms and a material failure of an overhead splice. Xcel Energy’s 800 MW Firm, Dispatchable Request for Proposals: Xcel requests: 1) find proposed agreements are in public interest and approve; 2) authorize cost recovery in the fuel clause for MN jurisdictional portion of costs; and 3) establish a procedural schedule for PUC to complete deliberations by mid-January for tax credits and avoid construction delays. Regarding Lake Wilson, Xcel states “we do not intend to continue negotiations but would encourage Invenergy to incorporate our feedback provided throughout the negotiations process and consider participating in a future RFP.” Invenergy filed a request for action on Xcel’s update to stop PPA negotiations with Lake Wilson Solar and asks for expeditious consideration of this request that the PUC require Xcel to resume PPA negotiations in good faith to reach a final agreement. According to Invenergy, Lake Wilson can be online by Dec. 31, 2027, if an agreement is reached soon and utilize tax credits and Xcel should not be allowed to circumvent the process with MISO market or Xcel’s self-build 300 MW Nobles Energy Storage. Murray County commented about the local economic impacts of ongoing congestion and curtailments and asked why Lake Wilson BESS Project, proposed to address the issues, is not moving forward. Department and LIUNA recommend approval of the power purchase agreements Xcel proposed, and the Department and Clean Energy Organizations requested additional record development around the Invenergy Lake Wilson project.
