Update for culturally specific or culturally responsive programs and disability responsive programs

During the 2021 Special Session, the Minnesota Legislature amended the definition of culturally specific program, created a new definition for disability responsive programs, and passed a rate increase for specific rate enhancements.

Providers that meet the current standards for culturally specific/special populations should continue to provide these services. DHS will provide further communication about any additional documentation requirements related to compliance with the national standards for culturally and linguistically appropriate services (CLAS), as determined by the commissioner of human services, when information about the requirements becomes available.

Additionally, DHS will provide further information on the standards and process for programs that meet the definition for a disability responsive program.

DHS is waiting for approval from the Center of Medicare and Medicaid Services, and will provide additional information once the approval is received.

For additional details on these changes, please review Minnesota Statutes 254B.01 Subd. 4a and 4b, Minnesota Statutes 254B.05 Subd. 5 (c), and Minnesota Statutes 254B.12, Subd. 4, or refer to the “Modifications to SUD Rate Add-ons and Rate Increase” section of the 2021 Behavioral Health Special Session Legislative Summary.
