Rule 25 and Comprehensive Assessment Pilot Proposal Request

During the transition to Direct Access for substance use disorder services, DHS is offering the opportunity for counties and tribes to submit a pilot proposal under MN Statutes 254B.13.

The goal of the proposal is to adapt the current Rule 25 assessment process to allow client choice of provider for the assessment and the resulting course of treatment.

The pilot allows counties and tribes to use an assessment tool that complies with both Rule 25 and Comprehensive Assessment in 245G.05 when done a by provider who meets the criteria in 245G.07 This removes the duplication of a county or tribe’s Rule 25 and the provider’s Comprehensive Assessment (CA).There is no other required change to forms or data systems.

  • Pilot proposals must describe: The process for responding to requests for Rule 25 assessments and assisting clients to find a credentialed provider of their choice for assessment and treatment per 9530.6620, Subpart 14.
  • Current or planned strategies to work with social services and courts services to refer clients to a comprehensive assessment and treatment providers who are MHCP and DAANES enrolled.

And the proposal must attest that:

  • The assessment tool complies with both Rule 25, Minnesota Rules, parts 9530.6600 to 9530.6655 and the Comprehensive Assessment found in Minnesota Statutes, section 245G.05.
  • County or tribe continues to determine client financial eligibility according to Rule 24, parts 9530.7000 to 9530.7030.
  • County or tribe continues to use current Client Placement Authorization and MMIS Service Agreement Forms, billing, and reporting processes.  
  • Assures all staff providing assessments and services meet the licensing requirements of 245G.

This pilot will remain in effect until the statewide SUD Reform Direct Access systems work and related policies are implemented by DHS. Counties and tribes interested in implementing this pilot project should send a proposal for review to Jana Nicolaison at jana.nicolaison@state.mn.us
