Public comment period open for amendments to the Elderly Waiver plan

Purpose: To announce a 30-day public comment period for amendments to the Elderly Waiver (EW) plan

Comment period begins: 8:00 a.m. 07/12/2017

Comment period ends: 5:00 p.m. 08/11/2017

Public comment period open for amendments to the Elderly Waiver plan

The Minnesota Department of Human Services (DHS) requests public comments on proposed federal waiver amendments for Elderly Waiver (EW) before submitting to the Centers for Medicare & Medicaid Services (CMS) for approval.

For information on how to access the full version of Minnesota’s approved waiver plans, see Community-Based Service Manual (CBSM) -How to get a copy of a federally approved waiver plan.

The amendments support the following areas:

Respite service

o   Adds camps as a provider type.

o   Expands options for respite provided in unlicensed settings.

o   Combines provider types that were individually listed under the general provider types of individuals and agencies that meet respite service standards.

Consumer Directed Community Supports (CDCS)

o   Changes Fiscal Support Entity (FE) to Financial Management Services (FMS)

o   Changes the FMS provider qualifications, enrollment criteria and oversight

o   Changes the scope of fiscal services an FMS provider will offer. FMS providers will not offer an agency model and removes co-employment as an option.

o   Clarifies that the agreement between the FMS provider and the participant does not determine who the employer of record and managing employer are.

o   Clarifies that government entities will not be used as a third party entity.

o   Removes the option for counties to enroll as an FE.

o   Changes certification to include Support Planners only.
