Boise, ID – The public has the opportunity to provide comments on the Proposed Rule IDAPA 20.03.04, Rules for the Regulation of Beds, Waters, and Airspace over Navigable Lakes in the State of Idaho. This section concentrates on rules for encroachments on navigable lakes.
The comment period is open from Sept. 3 to Sept 24.
The rule has been published in the Administrative Bulletin on September 3, 2025 – Pages 33-55. An unofficial strikethrough version of the proposed text is available on our website.
During the open comment period, people can participate by submitting a written comment to Idaho Department of Lands (IDL) or providing oral comments at a scheduled public hearing.
There are several options for attending a Sept. 11, public hearing including in person, by phone or remotely through Teams.

Summary of Proposed Rule Changes
Following Executive Order 2020-01, Zero-Based Regulation, this rule chapter is
scheduled to be repealed and replaced in 2025 for review during the 2026
legislative session. The overall regulatory burden has been reduced by
decreasing both total word count and the number of restrictive words in the new
rule chapter.
Most of the changes are a result of reorganizing and eliminating redundancies. The proposed rule includes the following changes:
- 13.46 percent reduction in word count, 27 percent reduced restrictive words
- Changing the rule title to “Rules for Encroachments on Navigable Lakes”
- Included definitions for common encroachments including breakwater, seawall, water line, residential area, and marine motor fuel dispensing facility.
- Incorporated by reference International Fire Code adopted through IDAPA 18.08.01.
