Notice of Proposed Reclassification of Groundwater

The Water Quality Division of the Wyoming Department of Environmental Quality (DEQ) is proposing to reclassify groundwater in the uranium production zones within the mining permit listed below as Class V, Mineral Commercial groundwater pursuant to Water Quality Rules and Regulations, Chapter 8. An aquifer exemption request has been submitted to the USEPA for the uranium producing zone.


Strata Energy, Inc., 2929 new Haven Rd, Oshoto, WY has applied for an in-situ uranium mining permit from the Land Quality Division (LQD) of the DEQ (PT0802). The mining permit area for the mining of uranium will be located in: all or portions of Sections 7, 17, 18, and 19 of Township 53N., Range 67W, and Sections 12, 13, and 24 of Township 53N., Range 68 W; Crook County, Wyoming. A separate public notice was developed by the LQD for the proposed mining permit and is being filed separately from this notice.


The mining shall occur in specified production zones within the Strata Ross Project Kendrick Expansion Area for the lower Lance and upper Fox Hills formations which range in depths from approximately 250 to 650 feet below ground surface. There is no domestic use of this aquifer in the immediate vicinity of the project area.


The public comment period begins on January 27, 2024 and ends February 26, 2024. DEQ has prepared a supplemental on-line public notice that is available at the DEQ’s website (https://deq.wyoming.gov/public-notices/) under the topic of interest entitled Water-Underground Injection Control. The website provides electronic access to a copy of the Statement of Basis (SOB) for an Aquifer Exemption that is completed to support the aquifer exemption request which is submitted to the USEPA for those portions of the aquifer coincident with the Class V classification.


All written comments and requests received prior to 5:00 P.M., February 26, 2024 in the Cheyenne office or submitted through and accepted by the online public comments portal at https://wq.wyomingdeq.commentinput.com/ will be considered. Comments submitted by email will not be considered. Requests for a contested case hearing on a final Department action appealable to the Council, must be made in writing to the chairman of the Environmental Quality Council and the DEQ director at the address above and state the grounds for the request pursuant to the Wyoming Department of Environmental Quality Rules of Practice and Procedure.
