The Underground Injection Control (UIC) Program regulates the storage of carbon dioxide in underground geologic reservoirs within the state. Operators of such facilities are required to receive coverage under a UIC permit. The purpose of this notification is to inform the public that the UIC Program is proposing the denial of one permit application (Permit # 2021-443 (WYS-041-00109)) for North Shore Exploration and Production, LLC, 105 Edgeview Drive, Suite 400, Broomfield, CO 80021.
Per Wyoming Water Quality Rules (WWQR) Chapter 24, Section 5(a)(i), the Director may deny a Class VI permit if the application is incomplete. The UIC Program has determined the permittee has not satisfied all requirements of Wyoming Water Quality Rules Chapter 24 and Wyoming Statutes 35-11-313 through 35-11-320; therefore, a UIC Class VI permit cannot be authorized.
The public comment period begins September 16, 2023, and ends November 16, 2023. An electronic copy of the proposed permit denial is available for review at https://deq.wyoming.gov/public-notices/ (under “WATER-Underground Injection Control”). A hard copy is available to view at the WDEQ Cheyenne Office, located at 200 West 17th Street, 2nd Floor, Cheyenne, WY 82002.
During the 60-day public comment period, any interested person may submit written comments on the proposed permit and may request a public hearing be held. Electronic comments may only be submitted through and accepted by the WDEQ comment portal provided at http://wq.wyomingdeq.commentinput.com/.
Requests for public hearings on permit applications or modifications must be made in writing to the Water Quality Division Administrator and shall state the reasons for the request. Requests for public hearings on permit issuance, denial, revocation, termination, or any other department action appealable to the Council, shall be made in writing to the Chairman of the Environmental Quality Council (Chairman, Wyoming Environmental Quality Council, 2300 Capitol Ave., Hathaway Bldg. 1st, Room 136, Cheyenne, WY 82002) and the WDEQ Director (Director, Wyoming Department of Environmental Quality, 200 West 17th Street, 4th Floor, Cheyenne, WY 82002) and shall state the grounds for the request. The Council shall hold hearings pursuant to the WDEQ Rules of Practice and Procedure.
