The Division of Air Quality, proposes to approve the following requests:

Black Hills Bentonite LLC (F031010, P0035938):  

CHAPTER 6, SECTION 2 CONSRUCTION/MODIFICATION PERMIT HEARING - The State of Wyoming, Department of Environmental Quality, Division of Air Quality, proposes to approve a request by Black Hills Bentonite LLC to establish the Keyhole State Project, a 317 acre mine, which will include exposed acreage, stockpiling and haul roads located in the E½ NW¼,W½ NW¼ NE¼, NW¼ SW¼ NE¼, S½ SW¼ NE¼, S½ SE¼ NE¼ and SE¼ of Section 16, T50N, R66W, approximately nine (9) miles east-northeast of Moorcroft, in Crook County, Wyoming. No blasting, hot mix asphalt plants or concrete batch plants are planned for this site. The applicant estimates an annual production rate of 25,000 tons per year.

Pursuant to the provisions of the Wyoming Environmental Quality Act and the Wyoming Air Quality Standards and Regulations, a public hearing relative to the requested issuance of an air quality permit for the proposed construction will be held in person at 6:00 pm, Monday,
April 10, 2023, in the Pine Haven Community Center, located at 3 Industrial Park, Pine Haven, in Crook County, Wyoming.

The hearing will be conducted pursuant to the provisions of Chapter IX, Section 5 of the Rules of Practice and Procedure adopted by the Environmental Quality Council, and therefore, will not be conducted as a contested case. The purpose of the hearing is to gather information concerning the emissions of air pollutants into the atmosphere and the impact of such pollutants on the ambient air quality. The scope of the hearing will be limited to such issues in order for the Department of Environmental Quality to determine whether or not the applicable Air Quality Standards and Regulations will be violated as a result of the construction of the facility.
