Notice of Proposed Underground Injection Control Permit

The Wyoming Department of Environmental Quality (WDEQ) Underground Injection Control (UIC) Program regulates certain discharges of pollutants into groundwaters of the state. Operators of these discharges are required to receive coverage under a UIC permit. The purpose of this notification is to inform the public that the UIC Program is proposing the issuance of a permit modification (Permit 2017-221) for the Bhagat, LLC Antelope Truck Stop injection well. The UIC program proposes to modify the injection well permit for this facility. The permittee is Bhagat, LLC, 4850 I-80 Service Road, Burns, WY 82053. The Antelope Truck Stop injection well is located in the NW¼ SE¼, Section 36, Township 49 North, Range 78 West of the 6th Principal Meridian, Laramie County. This facility operates as a truck stop with shower and laundry facilities, a mechanic shop, and a restaurant.

The modification updates permit sections C, H, and I, changing requirements to sample groundwater to requirements for sampling septic tank effluent as the down gradient point of compliance for the septic system. In accordance with Water Quality Rules, Chapter 27, Section 7(d)(iv) only those conditions to be modified shall be reopened and all other aspects of the existing permit shall remain in effect. Comments may only be submitted regarding the modified section(s).

The public comment period begins November 9, 2022, and ends December 9, 2022. Electronic copies of the proposed permit and relevant application materials are available for review.

During the 30-day public comment period, any interested person may submit written comments on the proposed permit and may request a public hearing be held. Electronic comments may only be submitted through and accepted by the WDEQ comment portal provided at http://wq.wyomingdeq.commentinput.com/.

Requests for public hearings on permit applications or modifications must be made in writing to the administrator and shall state the reasons for the request. Requests for public hearings on permit issuance, denial, revocation, termination, or any other department action appealable to the Council, shall be made in writing to the Chairman of the Environmental Quality Council (Chairman, Wyoming Environmental Quality Council, 2300 Capitol Ave., Hathaway Bldg. 1st, Room 136, Cheyenne, WY 82002) and the WDEQ Director (Director, Wyoming Department of Environmental Quality, 200 West 17th Street, 4th Floor, Cheyenne, WY 82002) and state the grounds for the request. The Council shall hold hearings pursuant to the WDEQ Rules of Practice and Procedure.
