Public Notice: Notice of Final Adoption: Solid Waste Rule Chapter 18

The Department of Environmental Quality, Solid and Hazardous Waste Division has adopted
Solid Waste Rule Chapter 18, Disposal of Coal Combustion Residuals in Landfills and Surface Impoundments.  Chapter 18 regulates the disposal of coal combustion residuals in landfills and surface impoundments at active electric utilities or independent power producers and consolidates regulatory authority over the disposal of coal combustion residuals into the Solid and Hazardous Waste Division.  Among other provisions, Chapter 18 incorporates by reference 40 CFR Part 257, Subpart D; Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals from Electric Utilities.  The regulations and permitting outlined in Chapter 18 provide the foundation for the Department’s application package for permitting primacy of these facilities to the United States Environmental Protection Agency.

The Environmental Quality Council adopted the proposed rule at a public hearing at the Capitol Extension Public Meeting Room 5, Herschler Building, 122 W. 25th Street, Cheyenne, Wyoming on June 14, 2022.  The final rule was filed with the Wyoming Secretary of State on August 19, 2022.
