Public Notice: Notice of Intent to Terminate Wyoming Department of Environmental Quality Underground Injection Control Permit

Cole’s Trailer Park (CTP) operates one (1) active injection facility permitted by the Wyoming Department of Environmental Quality (WDEQ) Underground Injection Control (UIC) Program under UIC Permit Number 2012-406. This facility injects domestic wastewater into subsurface formations through a septic system that is authorized under an individual permit issued by the UIC Program. This permit requires periodic groundwater monitoring for various constituents, and periodic reporting of the results to the UIC Program. This notice informs the public of the WDEQ’s intent to terminate CTP’s UIC Permit for failure to meet the monitoring and reporting conditions in their permit and order reduction of the septic system capacity of the facility to less than 2,000 gallons per day within one year of permit termination and apply for coverage under Converse County’s permitting authority. The septic system is located in the NE ¼ of the NE ¼, Section 21, Township 32 North, Range 71 West, Converse County, Wyoming.

CTP was previously provided opportunity to demonstrate compliance on July 28, 2021. CTP did not respond to the WDEQ’s request to demonstrate compliance with UIC Permit 2012-406; therefore, the WDEQ is proceeding with the permit termination process.

Requests for public hearings on permit applications or modifications must be made in writing to the administrator and shall state the reasons for the request. Requests for public hearings on permit issuance, denial, revocation, termination, or any other department action appealable to the Council, shall be made in writing to the Chairman of the Environmental Quality Council (Chairman, Wyoming Environmental Quality Council, 2300 Capitol Ave., Hathaway Bldg. 1st, Room 136, Cheyenne, WY 82002) and the WDEQ Director (Director, Wyoming Department of Environmental Quality, 200 West 17th Street, 4th Floor, Cheyenne, WY 82002) and state the grounds for the request. The Council shall hold hearings pursuant to the WDEQ Rules of Practice and Procedure.

The public comment period begins on November 17, 2021 and ends December 17, 2021. During the thirty (30) day public comment period, any interested person may submit in writing, comments on the draft permit and may request that a public hearing be held. Electronic comments may only be submitted through and accepted by the WDEQ comment portal provided at http://wq.wyomingdeq.commentinput.com/. Requests for a public hearing should indicate the name and full mailing address of the individual requesting a hearing, the interest that individual has in the project, and the grounds for holding a public hearing. All written comments and requests received prior to 5:00 P.M., December 17, 2021 in the Cheyenne office will be considered. Comments submitted by email will not be considered.
