Notice of Final Adoption Solid Waste Rules and Regulations, Chapter 1 and Chapter 7

The Department of Environmental Quality, Solid and Hazardous Waste Division has revised the Solid
Waste Rules and Regulations Chapter 1, General Provisions and Chapter 7, Financial Assurance
Requirements. The revisions to Chapter 1 amend definitions used in the rules, clarify the permit
application format, permit application procedure, public notice and comment procedure, and restructure passages in the Chapter for clarity. The revisions to Chapter 7 modernize the financial assurance regulations, retain all financial instruments, diversify the financial assurance portfolios, provide for immediate cash needs in the event of forfeiture, and ultimately reduce the reclamation liability risk to the State. The revisions also clarify the requirements for closure, post-closure, and corrective action cost estimates, clarify the requirements to participate in the State Guarantee Trust Account, and restructure passages in the Chapter for clarity.

The Environmental Quality Council adopted the revised rules at a public hearing at the Oil and Gas
Commission Building, 2211 King Boulevard, Casper, Wyoming on August 17, 2021. The final rule was filed with the Wyoming Secretary of State on September 27, 2021.
