The Wyoming Department of Environmental Quality
Water and Waste Advisory Board Meeting

 The Wyoming Water and Waste Advisory Board (WWAB) will meet on March 23, 2021, at 9:00 a.m. Due to public health concerns over the spread of COVID-19, the meeting will be held as a virtual public meeting.

The public is invited to attend remotely and comment on the proposed rules presented to the WWAB for its consideration. Interested parties may contact Gina Thompson at gina.thompson@wyo.gov or at (307) 777-7343 for information on how to join the virtual meeting via telephone or Zoom.

All written and oral comments received beginning on February 3, 2021 and before the adjournment of the March 23, 2021 WWAB meeting will be considered. The Solid and Hazardous Waste Division and Water Quality Division request submittal of written and electronic comments by 5:00 p.m. (MST) on March 8, 2021 to ensure inclusion in the analysis of comments presentations to the WWAB.

Water Quality Division

  • Rulemaking: WQRR Chapter 3
    • Summary: Add an exclusion for facilities that accept coal combustion residuals, remove passages that are restatements of the Wyoming Statutes, and reorganize passages and sections within the chapter for clarity.
    • At the conclusion of the presentation, DEQ will request that the WWAB consider the proposed revisions and provide advice for consideration to the Environmental Quality Council.

Solid and Hazardous Waste Division

  • Rulemaking: Solid Waste Rules and Regulations Chapter 1: General Provisions and 7: Financial Assurance Requirements.
    • Summary: The proposed revisions to Chapter 1 not only revise defined terms that are used in the rules but also clarifies the permit application format, the permit application procedure, the public notice and comment procedure, and restructures passages in the Chapter for clarity.
    • Summary: The proposed revisions to Chapter 7 modernize the financial assurance regulations, retain all financial instruments for use now and into the future, diversify the financial assurance portfolios, provide for immediate cash needs in the event of forfeiture, and ultimately reduce the reclamation liability risk to the State of Wyoming. The revisions also clarify the requirements for closure, post-closure, and corrective action cost estimates; clarify the requirements to participate in the State Guarantee Trust Account; and restructures passages in the Chapter for clarity.
    • At the conclusion of the presentation, DEQ will request that the WWAB consider the proposed revisions and provide advice for consideration to the Environmental Quality Council.
