Notice of Proposed Classification of Groundwater

Pursuant to Water Quality Division (WQD) Rules and Regulations Chapter 8, the WQD is providing notice for the proposed classification of the groundwater in the receiving zone as Class VI (Unusable/Unsuitable). This classification includes a specified receiving zone for two (2) Class I injection wells injecting into the Teckla Sandstone Formation which ranges in depth from approximately 6,523 to 6,657 feet below ground surface in the DW#1 well and approximately 6,446 to 6,643 feet below ground surface in the DW#2 well.

Republic EES, LLC, 10613 W. Sam Houston Pkwy, Suite 300, Houston, TX owns and operates two (2) Class I injection wells (DW#1 and DW#2) in Converse County, WY. The aquifer exemption area for the injection wells will be located in: all or portions of Sections 15, 16, 17, 20, 21, 22, 27, 28 of Township 38 North, Range 70 West; Converse County, Wyoming.

The public comment period begins on January 20, 2021 and ends February 19, 2021. DEQ has prepared a supplemental on-line public notice that is available at the DEQ’s website http://deq.wyoming.gov/wqd/public-notices/water-underground-injection-control/. The website provides electronic access to a copy of the Statement of Basis (SOB) for an Aquifer Exemption that is completed to support the aquifer exemption request which is submitted to the USEPA for those portions of the aquifer coincident with the Class VI classification.

During the public comment period, any interested person may submit in writing, comments on the draft permit and may request that a public hearing be held. Requests for a public hearing should indicate the name and full mailing address of the individual requesting a hearing, the interest that individual has in the project, and the grounds for holding a public hearing. All written comments and requests received prior to 5:00 P.M., February 19, 2021 in the Cheyenne office will be considered. Comments submitted by email will not be considered. Requests for a contested case hearing on a final Department action appealable to the Council, must be made in writing to the chairman of the Environmental Quality Council and the DEQ director at the address above and state the grounds for the request pursuant to the Wyoming Department of Environmental Quality Rules of Practice and Procedure.
