The Wyoming Department of Environmental Quality (WDEQ) is giving notice and soliciting comments from the public regarding the Hazardous Waste Management Facility Draft Permit for the Union Pacific Railroad (UPRR) Former Laramie Tie Plant Site (Facility). The Facility is approximately 150 acres in size, and is situated in portions of Sections 5 and 8 of Township 15 North, Range 73 West, in Albany County, Wyoming. The Facility is generally located to the south of the City of Laramie and adjacent to the Laramie River, near the intersection of I-80 and U.S. Hwy 287.

From 1886 to 1983, UPRR treated railroad ties and conducted other wood preserving operations at the Laramie Tie Plant. Creosote was the primary preserving agent used at the Facility, and pentachlorophenol (PCP) was also used. The source of contaminated soils and groundwater at the Facility are due to direct discharges of wastewater to low-lying areas, along with the accumulation of drips and spills associated with wood preserving operations. Starting in 1958, wastewater generated in the wood preserving process was transmitted via a shallow ditch system and contained in four unlined ponds, which are now collectively referred to as the “Former Surface Impoundment”. The Facility is no longer operational, and the Former Surface Impoundment was partially closed in 1984. Under the oversight of WDEQ and through a Hazardous Waste Management Facility Permit, UPRR will complete closure and post-closure care of the Former Surface Impoundment, including the corrective action management unit (CAMU), and continue to conduct site-wide corrective action.

All hazardous waste, currently generated at the Facility, is the result of corrective action activities and is designated as K001 listed waste. Materials at the Facility that receive the K001 waste code include, extracted groundwater, clarifier sludge, spent activated carbon, spent absorbent media, backwash water from activated carbon vessels, contaminated personal protective equipment, and miscellaneous debris. UPRR is registered as a large quantity generator to manage hazardous wastes that are shipped off-site for disposal.

The Draft Permit has been prepared as required by the WDEQ Hazardous Waste Rules and Regulations. The Draft Permit, Fact Sheet, Permit Application, and Administrative Record are available viewing and copying at the University of Wyoming Coe Library in Laramie, Wyoming, and the Wyoming Department of Environmental Quality/Solid and Hazardous Waste Division, located at 200 W. 17th Street, 2nd Floor, Cheyenne, Wyoming 82002. Any person may: 1) submit written comments on the Draft Permit, 2) request a notice of the final permit decision, and/or 3) request a public hearing. Written comments and requests for a hearing will be accepted by WDEQ during the public comment period, from November 18, 2020 through January 4, 2021. Written comments or requests must be received at the address below, no later than 5:00 p.m. on January 4, 2021.

A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised at the hearing. All written comments received by the deadline shall be considered in making the final decision and shall be answered according to the WDEQ Hazardous Waste Rules and Regulations. Each person who has submitted written comment or requested notice of the final permit decision will be notified. This notice shall include reference to the procedures for appealing a decision of a hazardous waste management facility permit.
