Final Adoption: Water Quality Rules and Regulations, Chapters 14 and 28

The Department of Environmental Quality, Water Quality Division has revised Water Quality Rules and Regulations Chapter 14, Financial Assurance Requirements, and Chapter 28, Standards for Issuing Permits for Commercial Oilfield Wastewater Disposal Facilities. Chapter 14 was revised by updating the requirements for financial assurance instruments for consistency with other divisions within the Department and banking statutes and regulations; by clarifying the requirements for closure, post-closure, and corrective action plans; and by restructuring passages in the Chapter for clarity and to meet Secretary of State formatting requirements. WQD created a new chapter, Chapter 28, to streamline and clarify the various design, construction, operation, monitoring, and annual reporting requirements for commercial oilfield waste disposal facilities.

The Environmental Quality Council adopted the revised rules at a virtual public hearing held in the Board of Equalization Board Room, First Floor Hathaway Building, 2300 Capitol Ave, Cheyenne, Wyoming on August 19, 2020. The final rules were filed with the Wyoming Secretary of State on August 20, 2020.
