Public Notice: Notice of Intent to Terminate Wyoming Department of Environmental Quality Underground Injection Control Permit(s)

Storm Cat Energy operates the Perry Irrigation System, permitted by the Wyoming Department of Environmental Quality (WDEQ) Underground Injection Control (UIC) Program under UIC Permit Number 12-241, UIC Facility Number WYS-033-132, located in Section 26, Township 56 North, Range 83 West, in Sheridan County, Wyoming. This facility injects coal bed methane produced water and nutrient enhancements into shallow subsurface formations to enhance agricultural production and is authorized for injection under an individual permit issued by the UIC Program. This permit requires periodic groundwater and injectate monitoring for various constituents, and periodic reporting of the results to the UIC Program. This notice informs the public of the WDEQ’s intent to terminate Storm Cat Energy’s UIC Permit for failure to meet the monitoring and reporting conditions in their permits and WDEQ’s intent to require reclamation.

The purpose of this notice is to provide Storm Cat Energy the opportunity to demonstrate compliance with UIC Permit 12-241. No monitor reports have been submitted for the Perry Irrigation System since January 2016.

The public comment period begins on May 5, 2020 and ends June 4, 2020. During the thirty (30) day public comment period, any interested person may submit in writing, comments on this notice to terminate Storm Cat Energy’s permit and may request that a public hearing be held. Requests for a public hearing should indicate the name and full mailing address of the individual requesting a hearing, the interest that individual has in the project, and the grounds for holding a public hearing. All written comments and requests received prior to 5:00 P.M., June 4, 2020 in the Cheyenne office will be considered. Comments submitted by email will not be considered.
