Public Notice for Mining Operations within 100 ft. of the Public Right-of-Way for County Rd 4 North Antelope Rochelle Mine, TFN 6 5/332

Peabody Powder River Mining, LLC has applied for a non-significant revision of its coal mining permit No. 569-T8 from the Land Quality Division of the Department of Environmental Quality for the State of Wyoming. The proposed revision affects approximately 260 acres of land located in: Township 41 North, Range 71 West, Sections 2, 3, 11, 12, 13, 14, 23, 24 and Township 42 North, Range 71 West, Sections 11, 12, 13, 14, 23, 26, 27, 34; Campbell County, Wyoming. This revision area is approximately 42 miles south of Gillette, Wyoming near County Road 4. This area can be found on the Teckla, Teckla SW and Reno Reservoir USGS quadrangle maps. This revision proposes mining operations within 100 ft. of the public right-of-way for County Road 4. When the area to affect lies within 100 ft. of the public right-of-way, a public comment period with the opportunity to request a hearing is required by Chapter 12, Section l(a)(v)(D) of the Coal Rules and Regulations. If a hearing is requested, a public notice shall be published by the Environmental Quality Council at least two weeks prior to the hearing. The Council shall publish this notice including the time, date and location of the hearing in a newspaper of general circulation in the locality of the proposed operation one time prior to the hearing. The hearing would be conducted as a contested case in accordance with the Wyoming Administrative Procedure Act (W.S. § 16-3-101 through § 16-3-115), and the right of judicial review would be afforded as provided in that act.

Revisions to the approved permit are proposed to the adjudication section and the mine and reclamation plan. A complete index sheet identifying all proposed changes are included with the revision application available for public viewing. Information regarding the proposed permit revision may be reviewed in the Offices of the Land Quality Division of the Department of Environmental Quality in Cheyenne and Sheridan; or the Campbell County Clerk's Office in Gillette, Wyoming. Comments and requests for a hearing on the proposed revision must be received by the Administrator of the Land Quality Division, Department of Environmental Quality, 200 West 17th Street, Cheyenne, WY 82002, before the close of business on February 28, 2019.
