Application for Amendment to Source Material License - Western Nuclear Inc.

Western Nuclear Inc. of Golden, Colorado has applied for an amendment of its Source Material License (WYSUA-056, Amendment 111) from the Land Quality Division of the Wyoming Department of Environmental Quality. The licensed area for possession of byproduct material in the form of uranium waste tailings generated by the licensee's past milling operations is located in: (Fremont County, Sections 1-3, 10-14,T29N, R92W; Sections 5-8, & 18, T29N, R91W; Section 31, T30N, R91W; Section 35s & 36, T30N, R92W, 6th P.M., Fremont County, Wyoming). The 5,398 acre area is approximately one mile northeast of Jeffrey City, Wyoming. This area can be found on the Stampede Meadow USGS 7.5 minute quadrangle map. The milling operation began in 1958, ceased in 1986, and has been in the reclamation process since then. The land, after reclamation, will be returned to wildlife habitat and possibly limited livestock grazing uses. The amendment requested a revision to License Condition 74 for modification of the Alternate Concentration Limit for Nitrate (NO3-N) at the Southwest Valley Point of Compliance (POC) well WN-21 from 70.7 mg/L to 500 mg/L, based on conservative groundwater flow and transport modeling.  In addition, the amendment proposed a long-term care boundary that encompassed the potential future transport of nitrate in groundwater.  Information regarding this application may be reviewed in the Office of the Land Quality Division, Department of Environmental Quality in Cheyenne or the Fremont County Clerk's Office, Riverton, Wyoming. A complete index sheet identifying all proposed changes is (i.e, proposed changes to the Source Materials License) included with the revision application available for public viewing. Written objections to the proposed license amendment must be received by the Administrator of the Land Quality Division, Department of Environmental Quality, 200 W. 17th Street, Suite 10, Cheyenne, WY 82002, before the close of business on Monday March 25th, 2019. Only the amendment is open for public review. If an objection specifically requests a public hearing with the Department and is found to be an aggrieved party as defined in W.S. §35-11-103(a)(vii), a public hearing shall be held after the final date for filing objections. The Land Quality Division shall publish notice of the time, date and location of the hearing in a newspaper of general circulation in the locality of the proposed operation once a week for at least two (2) consecutive weeks immediately prior to the hearing. The hearing would be conducted in accordance with the Wyoming Administrative Procedure Act (W.S. §16-3-101 through §16-3-115) as it pertains to hearings. The Wyoming Oil and Gas Conservation Commission will be mailed a copy of the map showing the proposed long-term care boundary associated with the application.
