CATEGORICAL EXCLUSION DETERMINATION

For the Town of Moorcroft, Water Mains Improvements

Crook County, Wyoming

The Department of Environmental Quality/Water Quality Division (DEQ) has conducted a review of the proposed Drinking Water Improvements project in accordance with EPA and State of Wyoming procedures for implementing the State Environmental Review Process. DEQ has determined that this project is eligible for a categorical exclusion. Accordingly, DEQ is exempting the project from further substantive environmental review requirements under the State Environmental Review Process. Neither an Environmental Assessment/Finding of No Significant Impact nor an Environmental Impact Statement/Record of Decision will be required for the proposed action. The following is a brief description of the situation and the proposed action and a brief statement of how the action meets the criteria for a categorical exclusion. The projects include replacement and upgrade of aging and undersized water mains with appropriately sized polyvinyl chloride (PVC) water mains. These improvements will increase system reliability and capacity, allow for looping of existing mains, and improve fire flows in the area. The water mains are identified as the Powder River Avenue Water Mains in the Town of Moorcroft Master Plan Level I Study. Completion of the projects is expected in December 31, 2021. The project is needed to replace aging and undersized water mains. Based on current cost estimates, the Town of Moorcroft plans to borrow $1,200,887.25 from the Wyoming Drinking Water State Revolving Loan Fund administered by the Wyoming Office of State Lands and Investments. The loan will be repaid from Ordinance No. 3-2015 that set the current water investment fee base rate and tier fee in anticipation of improvements to the water system. User fees will not need to be increased to repay the loan. Loan terms will be 2.5% interest rate and 20 years.

The Town of Moorcroft is aware of and accepts the fact that they will be responsible for any required mitigative actions associated with and including storm water runoff, erosion control, archeological/historic artifacts, and air quality concerns. These will be part of the standard State Revolving Funds Program contract conditions.

DEQ is granting an exclusion because this project replaces existing infrastructure in the same existing roadways as existing facilities. The utility replacements are located on the same property as existing facilities. This project will be completely constructed in previously disturbed ground, specifically previously installed water and sewer mains and the road above the water and sewer mains. DEQ has determined that exempting the proposed project from further review under the State Environmental Review Process will not result in adverse impacts to the population or the area of the Town of Moorcroft and Crook County, Wyoming.
