PROPOSED DISCHARGE OF DREDGED OR FILL MATERIAL TO A TRIBUTARY TO FISH CREEK

The Wyoming Department of Environmental Quality (WDEQ) has received a request from Biota Research and Consulting, Inc. on behalf of Christopher and Andrea Diamantis for State certification of U.S. Army Corps of Engineers Nationwide Permits #14 and #27, for discharge of dredged or fill material to Ellen Creek, a tributary of Fish Creek south of Teton Village, Wyoming. All waters within the Fish Creek drainage are designated Class 1. Point source discharges to Class 1 waters are prohibited except for storm water and construction related discharges. This certification will require meeting the provisions in Chapter 1, Section 7(b) of the WDEQ Water Quality Rules and Regulations, which allows these discharges under certain circumstances.

Proposed activities include installation of a permanent crossing over Ellen Creek for property access that will consist of an oversized 57-inch arch corrugated pipe culvert installed within 43-feet of stream channel. Other proposed activities include the creation of 6 riffles, 8 pools and 14 boulder features to diversify habitat and improve fish passage along 275-feet of re-aligned Ellen Creek. The project will result in relocation of 0.03 acre of wetland along the channel.
