PROPOSED PROGRAMMATIC AGREEMENT FOR REPAIR AND REHABILITATION OF THE SNAKE AND GROS VENTRE LEVEE SYSTEM IN TETON COUNTY

 The Wyoming Department of Environmental Quality (WDEQ) has received a request from the U.S. Army Corps of Engineers (USACE), Walla Walla, Washington District, to enter into a programmatic agreement under Nationwide Permit #3 for repair and rehabilitation of the existing levee system along the Snake and Gros Ventre Rivers. This agreement will be authorized under Nationwide Permit #3 and covered under Clean Water Act 401 State water quality certification. Segments of the Snake and Gros Ventre Rivers are designated as Class 1 waters where point source discharges are prohibited except for storm water and construction related discharges. This certification will require meeting the provisions in Chapter 1, Section 7(b) of the WDEQ Water Quality Rules and Regulations, which allows these discharges under certain circumstances.

This agreement allows the USACE to execute necessary repairs and rehabilitation along the Snake and Gros Ventre Rivers levee system. The purpose of the levee repair and rehabilitation is to reduce flood risk to residents and property by removing unnecessary vegetation and restoring the levees to their original design criteria. The project area includes the Snake River levee system north of the Highway 89 Bridge and south of the Moose Bridge and levees on the Gros Ventre River from the confluence with the Snake River upstream to the boundary of Grand Teton National Park. This agreement will be valid until March 18, 2022 unless NP#3 is modified, suspended or revoked prior to this date. Under this agreement, the USACE Walla Walla District must notify the WDEQ of its intent to initiate levee repair and rehabilitation no less than 7 days in advance of the maintenance event.
