FOR A DRAFT HAZARDOUS WASTE MANAGEMENT FACILITY PERMIT

The Wyoming Department of Environmental Quality (WDEQ) is giving notice and soliciting comments from the public regarding the Draft Permit for Sinclair Wyoming Refining Company.  The Sinclair Wyoming Refining Company is located in Sinclair, Wyoming at 100 East Lincoln Highway.  The comment period begins April 20, 2018 and ends June 4, 2018.

The Permit covers operating requirements for a hazardous waste surface impoundment, the Aggressive Biological Treatment Unit (ABTU) for treating refinery wastewater, post closure requirements for the closed Hazardous Waste Landfill (HWL), corrective action requirements for all Waste Material Management Units, and operational requirements for a Corrective Action Management Unit.

The ABTU is a dual cell, double-lined surface impoundment that receives and treats refinery wastewater.  The refinery wastewater is classified as a hazardous waste due to concentrations of benzene.  The wastewater is treated by aeration to enhance biological destruction of organics, including benzene.  Once the wastewater is treated, it is discharged to evaporation ponds located east of the active refinery.  The Draft Permit covers design, operation, groundwater monitoring and closure requirements for the ABTU.

The HWL is an unlined disposal unit which received refinery listed hazardous wastes.  The HWL received the final load of hazardous waste for disposal in November 1988 and was closed under an EPA approved Closure Plan in November 1989.  The Permittee submitted a written certification to EPA stating that the HWL was closed in accordance with the approved Closure Plan, as amended, on March 25, 1991. The Draft Permit covers post closure care and groundwater monitoring for the HWL.

The Draft Permit covers requirements for corrective action of units (WMMU) which have been used for the generation, treatment, storage or disposal of waste material, and any area (AOC) having a probable release of a hazardous waste or hazardous constituent that is not necessarily from a WMMU. 

Beginning April 20, 2018, through June 4, 2018, the WDEQ is providing an opportunity to comment on the Draft Renewal Permit for the Sinclair Wyoming Refining Company.  The Draft Permit has been prepared as required by WDEQ/Hazardous Waste Management Rules and Regulations.  The Draft Permit, Fact Sheet, Permit Application, and Administrative Record are available for public inspection and copying at the following locations:  the Carbon County Public Library in Sinclair, Wyoming, and the Wyoming Department of Environmental Quality/Solid and Hazardous Waste Division located at 200 W. 17th Street, 2nd Floor, Cheyenne, Wyoming  82002.

Any person may submit written comments on the Draft Sinclair Wyoming Refining Company Renewal Permit, may request a notice of the final permit decision, or request a public hearing.  Written comments and requests for a hearing will be accepted by WDEQ during the period April 20, 2018, through June 4, 2018.  Written comments or requests must be sent to the address listed below.   Written comments or requests must be received no later than 5:00 p.m. on June 4, 2018

A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised at the hearing.  All written comments received by the deadline shall be considered in making the final decision and shall be answered according to WDEQ/Hazardous Waste Management Rules and Regulations.  Each person who has submitted written comment or requested notice of the final permit decision will be notified.  This notice shall include reference to the procedures for appealing a decision on a hazardous waste management facility permit.
