The Wyoming Environmental Quality Council (EQC) will consider proposed changes to the Wyoming Air Quality Standards and Regulations (WAQSR) brought forth by the Wyoming Department of Environmental Quality (WDEQ), Air Quality Division (Division) at a public hearing to be held on December 5, 2017, in Room 1699 of the Herschler Building, 122 West 25th Street, Cheyenne, Wyoming, commencing at 2:30 p.m. (MST).

The proposed rulemaking Docket # 17-2101 (R-28) will involve revising WAQSR Chapter 14, Sections 3 and 5 (i.e. C14S3, C14S5).  Sections being updated to incorporation by reference from the Code of Federal Regulations (CFR) include: C14S5.  C14S3, was updated to include Basin Electric Power Cooperative’s new sulfur dioxide emissions reporting.  The revisions to C14S3, involve changes to the State Implementation Plan (SIP).  The Division will submit these SIP revisions to the Environmental Protection Agency. 

The proposed rulemaking Docket # 17-2102 (R-29) will involve revising WAQSR C2S12, C3S9, C4S6, C5S4, C6S14, C8S3, C8S10, and C11S2.  Sections being updated to incorporation by reference from the CFR include: C2S12, C3S9, C4S6, C5S4, C6S14, C8S10, and C11S2.  C8S3, is being updated to correct a reference to particulate matter in order to maintain consistency with federally approved language in 40 CFR 93.158(a)(4).  The revisions to C2S12, C3S9, C6S14, C8S3, C8S10, involve changes to the State Implementation Plan (SIP).  The Division will submit these SIP revisions to the Environmental Protection Agency.  

Comments on the proposed revisions contained in Docket #s 17-2101 and 17-2102 may be submitted beginning October 10, 2017 and ending at 5:00 p.m. (MST) on November 24, 2017.  Written comments should be submitted to: Administrator, Air Quality Division, 200 West 17th Street, Cheyenne, Wyoming, 82002; faxed to 307-635-1784; or submitted via the Division’s electronic public comment form.  Electronic comments may be submitted by filling out the public comment form provided at: http://aq.wyomingdeq.commentinput.com/.  Copies of the public notice, Notice of Intent to Adopt Rules, and the proposed rules are available at the same address.  If you have any questions regarding the proposed rules, contact Amber Potts, Air Quality Division, at 307-777-2489.  The Division will file an Analysis of Comments with the EQC prior to the December 5, 2017 public hearing.  The proposed rules, comments submitted, and the response to comments will be posted on the Council’s website at: https://eqc.wyo.gov/Public/Dockets.aspx under Docket # 17-2101 for R-28, and #17-2102 for R-29.

The EQC will consider proposed rules, written and electronically filed comments, and the Division’s Analysis of Comments, along with any modification proposed by the Division to the draft rules.  At the public hearing, oral statements that focus on the previously received comments, the Division’s Analysis of Comments, and issues raised by the analysis, will be accepted.  The EQC will determine if the record will remain open beyond the close of the scheduled hearing.  If the comment period is extended, the extensions will be posted on the Air Quality website, as well the EQC’s website.  The EQC, however, may close the record and make a final decision regarding the rules prior to concluding the hearing.

Any Person wishing to use a digital presentation during their testimony before the EQC must provide a digital copy to the EQC no less than three (3) days prior to the hearing unless you contact the EQC and receive an extensions for good cause.  Failure to submit a timely digital copy will result in the person not being allowed to use the presentation during their testimony.
