Notice of Draft Modification for the Former Yellowstone Cody Refinery Hazardous Waste Permit

The Wyoming Department of Environmental Quality (DEQ) has reviewed the Permit Modification Request (Modification Request) submitted by Flying J Petroleums, Inc. (FJP) on November 09, 2016.  The Modification Request proposed to enter into a Remedy Agreement (RA) under the Voluntary Remediation Program (VRP), remove the unsaturated zone monitoring program from the land treatment area, and continue the post-closure care period on a 30-year rolling period for the Former Yellowstone Cody Refinery located approximately one-mile north of Cody, Wyoming, in portions of Sections 20, 21, 28, and 29 of Township 53 North, Range 101 West, 6th Principal Meridian of Park County.  The DEQ determined the Modification Request is complete and technically adequate.  Based on the Modification Request, the DEQ has completed a Draft Modified Permit.  Therefore, DEQ is giving notice and soliciting comments from the public regarding the FJP Draft Modified Permit.  FJP currently conducts activities under a Permit issued on December 13, 2013.  The FJP Draft Modified Permit serves to modify the 2013 Permit.  The FJP Draft Modified Permit addresses post-closure care and corrective action for the regulated unit, while the RA addresses cleanup on the Refinery Property and Waste Management Area.

The public comment period begins March 9, 2017, and ends April 23, 2017.  The FJP Draft Modified Permit, Fact Sheet, Permit Modification Request, and Administrative Record are available for inspection and copying at the following locations: DEQ/Solid and Hazardous Waste Division (SHWD), 510 Meadowview Drive, Lander, Wyoming; DEQ/SHWD, 200 West 17th Street, 2nd Floor, Cheyenne, Wyoming, and the Park County Library, at 1500 Heart Mountain Street, Cody, Wyoming.

Any person may submit written comments on the Draft Modified Permit, may request a notice of the final permit decision, or request a public hearing.  Written comments and requests for a hearing will be accepted by the DEQ during the public comment period.  Written comments or requests must be sent to:
