Updated List of Offenses Affecting Eligibility

The Division of Quality Assurance has updated P-00274, Offenses Affecting Eligibility as a result of recent statutory changes. The publication is used to complete caregiver background checks.

Providers are advised to begin using the updated list of offenses effective immediately. Providers do not need to complete new caregiver background checks for existing staff but must consult the updated publication going forward.

The following offenses were added:

  • Barring offenses for facilities and programs serving only adults
    § 940.60(2), Substantial battery
    § 940.60(3) (a), (b), or (c), Aggravated battery
    § 940.66(2), Battery to an elder person
  • Barring offenses for facilities and programs serving any children
    § 940.60(2), Substantial battery
    § 940.60(3) (a), (b), or (c), Aggravated battery
    § 940.66(2), Battery to an elder person
    § 948.072, Grooming of a child for sexual activity
  • Offenses, which if occurred in the past 5 years, require obtaining and reviewing criminal complaint and judgment of conviction
    § 940.60(1), Battery
    § 940.61, Battery; bodily harm caused by certain persons
    § 940.62, Battery; bodily harm caused to certain persons
    § 940.65, Battery, substantial battery, aggravated battery to an unborn child
    § 947.016(1), (2), or (3), Threatening to cause bodily harm
