DHS 75 Residential Treatment Facility Plan Review and Inspection
As part of the Division’s commitment to Teach, Learn and Collaborate, the Division of Quality Assurance (DQA) is sharing the following messaging regarding DHS 75 facilities.
Background The Division of Quality Assurance (DQA) certifies community substance use treatment services under Wis. Admin. Code ch. DHS 75, which establishes standards for these services. Community-Based Residential Facilities (CBRFs) are licensed by DQA under Wis. Admin. Code ch. DHS 83, which establishes standards of care for residents in CBRFs.
Prior to October 1, 2022, DHS 75 required CBRF licensure for all DHS 75 residential treatment facilities (DHS 75.53, DHS 75.54, DHS 75.55, DHS 75.56, DHS 75.57, DHS 75.58). Plan review was conducted by DQA prior to issuing the CBRF license. DHS 75 was revised on October 1, 2022. This revised rule removed the requirement for DHS 75 residential service facilities to also hold a CBRF license; however, the revised DHS 75 requires residential treatment providers to meet the physical environment, safety, building design, building code, and building standards in DHS 83.
Since a CBRF license is no longer required for a DHS 75 residential treatment facility, the Department of Safety and Professional Services (DSPS) had plan review authority for DHS 75 residential treatment facilities and Chapter 50 of the Wisconsin Statutes delegates plan review authority to DQA for hospitals, nursing homes, hospices, and CBRFs.
DQA will now conduct plan review and inspections for all DHS 75 residential treatment facilities.
DQA and DSPS signed a Memorandum of Understanding (MOU) on January 2, 2024, to delegate the plan review authority from DSPS to DQA for all DHS 75 residential treatment facilities plan reviews and inspections. This creates a one-stop shop for applicants seeking certification from DQA.
DQA updated the Plan Review Application (F-62333) and DHS 75 Residential Service Initial Certification Application (F-03082E) to reflect this change.
All providers seeking DHS 75 Residential Treatment Certifications are required to submit their Plan Review Applications and construction documents to DQA for review and approval prior to certification.
