DQA Oversight of Adult Day Care Centers Transferred from the Bureau of Assisted Living to the Bureau of Health Services
Effective March 13, 2022, the Division of Quality Assurance (DQA) transferred oversight of Adult Day Care Centers (ADCC) from the Bureau of Assisted Living (BAL) to the Bureau of Health Services (BHS). Staff from BHS are responsible for conducting initial and regular recertification surveys and investigating complaints in ADCCs in accordance with the requirements in Wis. Admin. Code ch. DHS 105.14.
Adult Day Care Providers are required to be in compliance with Home and Community-Based Services in nonresidential settings. Federal requirements define the qualities of settings eligible for reimbursement for Medicaid home and community-based services. Under the new requirement, the Department of Health Services must ensure that settings in which home and community base services are provided meet, and remain in compliance, with the settings rule requirements.
Annual reports The ADCC biennial report and $127 fee, as required in Wis. Stat. §49.45(47)(c) and (dm), will be sent to providers on January 31 of each odd-numbered year and will be due on March 31. If you have questions, please contact Thomas Rylander at Thomas.rylander@dhs.wisconsin.gov.
Change of ownership and closure The ADCC shall notify BHS within 30 days before a change of ownership or closure, as required in Wis. Admin. Reporting requirements The ADCC is required to report the following information to the Bureau of Health Services at the time prescribed in Wis. Admin. Code ch. DHS 105.14.
