IMPORTANT: CMS Announces End of Blanket Waivers for Specific Providers Affecting Nurse Aide Emergency Training Programs and Temporary Nurse Aides

CMS Issues Memo QSO-22-15-NH & NLTC & LSC Ending Specific Blanket Waivers Within 30 and 60 Days

On April 7, 2022, the Centers for Medicare & Medicaid Services (CMS) issued QSO-22-15-NH & NLTC & LSC (PDF) - Update to COVID-19 Emergency Declaration Waivers for Specific Providers.

As stated in QSO-22-15, CMS is ending specific blanket waivers which allowed for the creation of Nurse Aide Emergency Training Programs (ETPs) and the use of Temporary Nurse Aides. These employment and training flexibilities will end 60 days from the publication of QSO-22-15-NH & NLTC & LSC (PDF).

To ensure that all training programs have time to complete current ETP training classes and convert back to pre-approved permanent training programs where applicable, please note the following timeline:

  • On or before May 7 (30 days after CMS notification)
    • New ETPs must be approved prior to May 7 in order to begin a new class
    • No new ETP training classes initiated
  • On or before June 6 (60 days after CMS notification)
    • ETPs must complete all training classes and submit checklists
    • DQA rescinds all waivers for ETPs and temporary aides. Previously approved permanent training programs may continue to train at the hours for which they are approved
    • 120-day clock starts for all trained students to test and get on the Registry, both for ETP and traditionally trained students (October 4, 2022)
    • Temporary aides, not on a path to the Wisconsin Nurse Aide Registry, must stop working as nurse aides unless they are employed full time and enrolled in an approved permanent nurse aide training program. Out-of-state certified nurse aides who are not on the Wisconsin Nurse Aide Registry are considered temporary aides.
