Mobile Restaurant
-serves meals
-at a temporary location, that is not in conjunction with an
event
-must operate in conjunction with a licensed service base
-examples are hot dog carts and taco trucks on a street
corner
-mobile restaurant and service base are based on prepackaged
or low/moderate/high complexity
-if the licensee of the mobile and the restaurant are the
same licensee=no base license required
-if the owner of the mobile and the restaurant are not the
same licensee=base license is required
-if the base is located in an agent territory, the base will
be inspected and licensed by the agent health department
Mobile Retail Food Establishment
-does not serve meals
-at a temporary location, either in conjunction with an
event or not
-if in conjunction with an event, examples are kettle corn
tent at a farmers market, prepackaged ice cream truck, cotton candy truck at
state fair
-if not in conjunction with an event (and processes), then
it must operate in conjunction with a licensed service base; an example is an
ice cream truck that scoops out orders on a street corner
-non profit organizations can operate 12-days before a
mobile retail food establishment license is required
-mobile retail food establishment with or without a service
base is based on sales volume and process type

TEMPORARY RESTAURANTS
-serves meals
-at a fixed location, in conjunction with an event
-for no more than 14 consecutive days
-example is a hamburger stand at a festival
-a special organization can operate 3-days before a
temporary restaurant license is required
-based on one fee

This section provides you with some frequently asked questions and their answers. Use these as a reference when responding to questions while you are working in the field.
Question 1: Who issues the license?
Answer:
If the operator of the Temporary Restaurant, Mobile
Restaurant or Mobile Retail Food Establishment operates in multiple
jurisdictions, or exclusively in an area that is non-agent, the license will be
issued by DATCP.
If the food facility operates exclusively in the jurisdiction
of a single agent, the local agent will issue the license.
Question 2: What are other license requirements?
Answer:
-only one annual license should be issued to the
operator
-a DATCP annual license (July
1, 2016-June 30, 2017) will be accepted by all agents
-the agent may impose an inspection fee at
each special event where the license is used, if this fee is authorized in
local ordinance
-the original licenses must be posted in the establishment to be accepted
-failure to
produce an original active license would result in purchasing a new license in the jurisdiction they are operating in that day, or
not operating; if they are still planning on operating across
jurisdictions they should plan on getting the State license after the event
Question 3: What are examples of events?
Answer: A fair, carnival, circus, public
exhibition, anniversary sale, or an occasional sales promotion
Question 4: What are examples of meal or non-meal items?
Answer: Meal=Pasties, Corn Dogs, Hotdogs, Brats, Hamburgers, Pizza, Cooked Fruits and
Vegetables
Non-meal=Bakery, Confectionery, Drinks, Dairy Products, Sliced Fruit and Nuts
Question 5: What is processing?
Answer: Food processing means the manufacture or preparation of food for sale through the process of canning, extracting, fermenting, distilling, pickling, freezing, baking, drying, smoking, grinding, cutting, mixing, coating, stuffing, packing, bottling, or packaging, or through any other treatment or preservation process.
