Medicare patients under “observation status” win right to appeal

Last week a federal court judge ruled in a nationwide class action lawsuit that Medicare beneficiaries can appeal denied coverage for nursing facility services after hospitals changed their status from “inpatient” to “observation.”

The common hospital practice of admitting patients under observation status led to denying Medicare coverage following nursing facility stays. Medicare covers nursing facility care for patients who have status as an “inpatient” and they meet the “three-midnight rule.”

This important new decision will allow thousands of Medicare beneficiaries, who were denied coverage for nursing facility stays, to appeal changes in status to “observation” going back to 2009, and possibly receive reimbursement for uncovered nursing facility charges.
